Terms of Service

These terms are the agreement between you and Woodberry Holdings, Inc. covering your use of the Skaz app. Please read section 04 in particular — it explains the limits of what a fitness app can responsibly tell you.

01Agreement

By downloading, accessing, or using Skaz, you agree to these Terms. If you do not agree, do not use the app. These Terms incorporate our Privacy Policy by reference.

02Eligibility

You must be at least 16 years old to use Skaz. By using the app you represent that you meet this requirement and that you have not previously been removed from the service.

03Your account

You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity that happens under your account. Tell us promptly at support@skazfitness.com if you believe your account has been compromised.

You may delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms, as described in section 10.

04Skaz is not medical advice

Skaz is a general fitness logging tool. It is not a medical device, and nothing in it is medical advice, diagnosis, or treatment.

Consult a qualified physician before starting any exercise program, particularly if you have a medical condition, are pregnant, are taking medication, or have a history of injury or disordered eating.

Strength training carries an inherent risk of injury. You participate at your own risk and are solely responsible for exercising within your ability and for using safe technique and equipment.

If you experience chest pain, dizziness, shortness of breath, or any symptom that concerns you, stop immediately and seek medical attention. Do not delay seeking care because of anything you read in Skaz.

Recovery, sleep, and strain figures from connected wearables are consumer-grade estimates produced by third-party devices. They are not clinical measurements and should not be used to make medical decisions.

05AI features

Skaz includes an AI coaching feature that generates responses using a large language model. It is written to deliver information in a deliberately exaggerated, comedic fitness-culture persona. That persona is entertainment. The underlying content is general information only.

AI-generated output may be inaccurate, incomplete, or unsuitable for your circumstances, and it does not know your medical history. It is not a substitute for a qualified coach, physician, or registered dietitian. Everything in section 04 applies to it in full. Use your own judgment and verify anything that matters.

We may limit the number of AI requests per user per day, and we may change, suspend, or remove the feature at any time.

06Your content

You keep ownership of the workouts, notes, photos, and other content you put into Skaz. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the service to you and to the people you share it with. This license ends when you delete the content or your account, except for copies retained in backups until they are purged on our normal rotation.

You represent that you have the rights to the content you upload and that it does not infringe anyone else's rights.

07Acceptable use

Do not:

Post content that is unlawful, harassing, hateful, defamatory, or sexually explicit
Promote self-harm, disordered eating, or the use of illegal substances
Impersonate another person or misrepresent your affiliation with anyone
Scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the service or its underlying systems
Interfere with the operation of the service, including through automated request volume
Use the service to build a competing product or to resell access

08Connected third-party services

Skaz can connect to WHOOP, Apple Health, and other wearable platforms. Those services are operated by third parties under their own terms and privacy policies, and your use of them is governed by those agreements, not this one. We do not control their data, their accuracy, or their availability, and we are not responsible for changes they make to their APIs or for interruptions in their service.

09Subscriptions and billing

Skaz offers optional paid features. Subscriptions are sold and processed through the Apple App Store and are billed to your Apple Account.

Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple Account settings, not in Skaz. Refunds are handled by Apple under their policies; we cannot issue them directly.

We may change pricing on a going-forward basis with notice before your next renewal.

10Termination

You may stop using Skaz and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the service. Where circumstances allow, we will give you notice and an opportunity to export your data. Sections 06, 11, 12, 13, and 14 survive termination.

11Disclaimers

To the fullest extent permitted by law, Skaz is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data will never be lost.

12Limitation of liability

To the fullest extent permitted by law, Woodberry Holdings, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or personal injury arising out of or relating to your use of the service.

Our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law, and nothing in these Terms limits liability that cannot lawfully be limited.

13Indemnification

You agree to indemnify and hold harmless Woodberry Holdings, Inc. and its officers and contractors from any claim, demand, loss, or expense, including reasonable legal fees, arising from your content, your use of the service, or your violation of these Terms or of any law or third-party right.

14Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts. Nothing here prevents either party from seeking relief in small claims court.

15Apple

These Terms are between you and Woodberry Holdings, Inc. only, not with Apple. Apple is not responsible for Skaz or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16Changes to these Terms

We may update these Terms from time to time. We will post the revised version here and update the date at the top, and we will notify you of material changes before they take effect. Continuing to use Skaz after changes take effect means you accept them.
